WHAT IF...

Cards (3)

  • IF MILAH KNOW THE NEXT DAY
Referring to this case, an offer was made by Marsha to reward for those who can find her cat, Puteh. An offer was made to the general public, so anyone can accept it as long as he or she fulfilled all the conditions in the offer as illustrated in the case of Carlil V Carbolic Smoke Ball. This means that Milah can accept the offer since the offer has made to general public.
  • IF MILAH KNOW THE NEXT DAY
In Milah's case, it is clear that when Milah returned the lost cat to Marsha, Milah was unaware of the reward advertised by Marsha. It means that an offer by Marsha was not communicated to Milah at the time she returned the cat. Based on section 4(1) Contract Act and the case of R V Clarke. There is no communication of offer. Therefore, there is no contract.
  • IF MILAH KNOW EARLY
In Milah's case, if Milah knows about the reward before she returned the cat to Marsha, it means that an offer by Marsh was communicated to Milah. Since, there is communication of an offer, thus there is an agreement. Therefore, Milah is entitled to claim the reward of 1000 offered by Marsha ad there is a contract.
