• Wilkinson entered into a binding contract to sell to bisset farmland for 13,260
• Wilk told bisset that with a good six horse team it would carry 2,000 sheep
• It was unsuccessful for 2 years
• Bisset brought action for misrepresentation and get his money back
• The sellers statement was a matter of opinion . Both parties knew about the farm has not been used as sheep farming before which means the farmland capacity was an estimate
• Point of law - If an untrue statement is an uninformed opinion, it is not an untrue statement of fact.
