NIGHT SHIFT DIFFERENTIAL

• Night Shift Differential (NSD)


  Additional compensation of ten percent (10%) of an employee's regular wage for each hour of work performed between 10 p.m. and 6 a.m.

  1. Every employee shall be paid

  2. Not less than ten percent (10%) of his regular wage

  3. For each hour of work performed between ten o'clock in the evening and six o'clock in the morning
• Employees not entitled to Night Shift Differential

  • Government employees
  • Those of retail and service establishments regularly employing not more than five (5) workers
  • Kasambahay and persons in the personal service of another
  • Managerial employees
  • Officers or members of a managerial staff
  • Field personnel
• Night Shift Differential is regulated under Article 86 of the Labor Code

  1. Where night shift (10 p.m. to 6 a.m.) work is regular work

  2. Where night shift (10 p.m. to 6 a.m.) work is overtime work
