  • Occupiers' Liability Act 1984 - Trespassers
    The Occupiers' Liability Act 1984 applies to trespassers. These are people who have not been given permission to be on the land.
    Section 1(1)(a) of the Occupiers' Liability Act 1984 - 'in respect of any risk of their suffering injury on the premises by reason of any danger'.
    The categories of trespassers that an occupier might encounter: adult trespassers and child trespassers.
  • Occupiers' Liability Act 1984 - Trespassers
    Section 1(3) of the Occupiers' Liability Act 1984 - the occupier owes a duty if:
    A) They are aware of the danger or has reasonable grounds to believe it exists.
    B) They know or has reasonable grounds to believe that the other is in the vicinity of the danger concerned.
    C) The risk is one the occupier is reasonable expected to offer the other some protection.
  • Occupiers' Liability Act 1984 - Trespassers
    Section 1(4) of the Occupiers' Liability Act 1984 - The occupier needs to 'take such care as in reasonable in all the circumstances of the case to see that he (the trespasser) does not suffer injury on the premises by reason of the danger concerned'.
