  • How did Clare’s Law come about?
    In 2009 Clare Wood was beaten, raped and strangled and her body was set on fire.
    She previously had a relationship with her assailant but ended in 2009 but continued to harass her
    He had previous convictions for violence against women
    Her father felt the police had inadequately dealt with the case
  • What was Clare’s Laws aims? 

    enable women to know about their partner’s violent past - gained support from Radio Key in Manchester - petitions.
  • Did Clare’s Law lead to anything?

    Led to the 2014 Domestic Violence disclosure scheme which ran through all 43 forces
    It had 2 procedures:
    • Right to ask- member of the public can apply to the police for them to disclose information about a partner or someone they know
    • Right to know - police disclose information to protect a potential victim
  • What are the concerns about the Disclosure Scheme 2014?

    Police are not obliged to disclose information and will meet with other safeguarding agencies to decide whether its disclosure is necessary to protect a person in question

  • Was Clare’s Law Successful?
    The disclosure led to 8490 disclosures in 2016-2017
  • What happened to Ann Mings Daughter?

    Murdered by Billy Dunlop, he was charged - after 2 juries failed to reach a verdict he was acquitted
    He was then jailed for another savage attack on a former lover, while in prison he admitted he murdered Ann Ming’s daughter.
    He was prosecuted for committing perjury but not murder due to double jeopardy law
  • What is the double jeopardy law?

    Stops people being tried again for a crime of which they have been acquitted
    Prevents injustice - by stopping the state for prosecuting someone repeatedly
    Lead to injustice - where new evidence indicates someone previously acquitted was actually guilty but cannot be tried due to the law

    Change double jeopardy law
    lobbied politicians, press, to and radio to publicise the case

    Led to 2003 criminal justice act - permitted certain serious crimes to be re-tried.
