  • The engagement is based on consensus and thus the usual rules in connection with consensus apply.
  • The engagement is concluded by means of offer and acceptance. Unlike marriage the parties do not have to be in each others presence.
  • Both parties to the engagement must have capacity to act.
  • A minor must obtain his or her parent's permission to become engaged
  • At the time of entering into engagement the parties must be in a position to conclude a civil marriage with each other.
  • An engagement is terminated when the parties marry each other.

  • Termination of engagement is lawful when there is a valid reason (justa causa) to termination the engagement.
  • A termination of an engagement is unlawful when the breach of promise takes place if one of the parties terminates the engagement without valid reason reason (justa causa).
