The engagement is based on consensus and thus the usual rules in connection with consensus apply.
The engagement is concluded by means of offer and acceptance. Unlike marriage the parties do not have to be in each others presence.
Both parties to the engagement must have capacity to act.

At the time of entering into engagement the parties must be in a position to conclude a civil marriage with each other.

Termination of engagement is lawful when there is a valid reason (justa causa) to termination the engagement.
A termination of an engagement is unlawful when the breach of promise takes place if one of the parties terminates the engagement without valid reason reason (justa causa).
