SC can protect rights

• SC can use incompatibility statements given to it under the HRA acts that proposed laws are in breach of teh HRA
• can interpret the European convention of Human Rights
• SC enforces the rules of laws- example- Cadder v HM advocate 2020 found that scottish police were in breach not only of the ECHR but also of the Scotland act
• asserts common laws- example district dover council v CPRE Kent 2017 if planning permission has been granted against the advice of its own professionals than the local authority are obliged to give their reasons why
