SC enforces the european convention on human rights when interpreting executive actions and in cases of judicial review
SC cant set a piece of parliamentary legislation away but they can declare that a law is incompatible with the ECHR which pressurises the government to amend teh law properly
SC imposes the common law when asserting the rights of citizens
sentencing in criminal cases- judges wish to have a free hand in determining sentences on a case by case basis, government responsible for law and order
rights- judges have the duty to preserve human rights but these may hinder the governments attempts to maintain national security
