  • Notice
    Due process requires
    (1)    Notice to be reasonably calculated under all circumstance
    (2)    To appraise the interested parties of the pendency action
    (3)    And afford them an opportunity to present their objections
  • Notice can be given by traditional methods such as
    1. Personal Service of process or
    2. Serving an Agent
  • Service of Process (SOP)
    SOP must be served
    1. served within 90 days of the complaint being filed
    2. by any person who is over the age of 18 and not a party to the action
  • Service of process may be:
    1. personally served
    2. the papers can be left at the defendant's residence with a responsible party of suitable age and discretion who also lives there, or at the defendant's place of business, or
    3. delivered to an agent authorized to accept service of process
