• pro - there is legal aid available unlike when using ADR
• pro - judges are legal experts and so will make correct decisions unlike with ADR which they might be trained but not in certain areas which judges are
• pro - there are appeal routes available unlike in ADR where there arent any appeal routes available.
• con - it is expensive due to the costs of lawyers and court costs, meaning that justice might not always be given because it may deter them from going to court
• con - the loser will have to pay their own fees as well as the winners fees meaning it will be expensive
• con - may be an inequality of bargaining powers when taking on larger companies who can afford more expensive and trained lawyers
• con - expensive because there is no legal funding in the small claims court meaning have to pay it themselves if within the limit for the small claims which is less than £10k
