S.18 GBH and Wounding

• GBH AR: An act which causes grievous bodily harm

  • DPP v Smith - 'really serious harm'
  • Severity of injuries is assessed based on age and health - Bollom
  • Bodily can include psychiatric harm (Burstow) or deliberate infection of a serious disease (Dica)
• Wounding AR: To unlawfully and maliciously wound

  • Must break both layers of the skin - Eisenhower
• GBH MR: Intention to cause GBH or intention to resist arrest and be reckless as to whether their actions would cause a wound or injury - Morrison
• Wounding MR: Intention to wound will not suffice, they must have intention to cause GBH
