Negligence

• Negligence falls into category of law of the fort.
• Provides a remedy in situations where the claimant (c) is owed a duty of care by the defendant (D) and D by breaching their duty has caused C a loss.
• Typically personal injury or property damage.
• For a successful negligence claim, claimant has to prove 3 elements: duty of care, breach of duty, and damage caused.
