  • Responsibilities of medical technologists
    1. Increase knowledge of how to search for underlying causes of sickness and disease
    2. Recognize evidence of physical changes
    3. Make important chemical analyses
    4. Conduct other valuable tests helpful in caring for the sick
  • Medical technologists share with those who directly care for the sick

  • Criminal law
    A branch of public law concerned with acts or omissions, which are primarily wrongs against the State
  • A criminal case is denominated "People of the Philippines vs. XXX"
  • Penal laws

    Acts of the Legislature prohibiting certain acts or omissions and establishing penalties for their violations
  • Statute is penal

    • The law defines an act or omission as criminal
    • It prescribes a penalty therefore
    • It must be an act of the Legislature
  • R.A. 9346 (Act Prohibiting the Imposition of Death Penalty) provides for the prohibition on death penalty and repeal of R.A. 8177 and R.A. 7659
  • Mala in Se
    A crime or an act that is inherently immoral, such as murder, arson, or rape
  • Mala Prohibita
    An act that is considered a crime because it is prohibited by statute, although the act itself is not necessarily immoral
  • R.A. 6425 is "The Dangerous Drugs Act of 1972"
  • R.A. 9165 is "The Comprehensive Dangerous Drugs Act of 2002"
  • R.A. 9165 is a special penal law, a mala prohibita
  • Violation of the drug law is malum prohibitum; mere commission of prohibited acts constitutes the offense and suffices to charge and convict an individual regardless of criminal intent

  • Elements of illegal sale of drugs under Section 5, Article II, R.A. 9165
    • The identity of the buyer and seller, object, and consideration

  • The offense of illegal sale requires merely the consummation of the selling transaction which happens the moment the buyer receives the drug from the seller

  • The requirement of testing is mandatory for prosecutions under Section 12

    • Possession or control by the accused of any equipment, apparatus or other paraphernalia fit or intended for smoking, consuming, administering, injecting, ingesting, or introducing any dangerous drug into the body
    • Such possession is not authorized by law
  • Possession or introducing any dangerous drug into the body shall be prima facie evidence that the possessor has smoked, consumed, administered to himself, injected, ingested or used a dangerous drug, and to have violated Section 15 on use
  • Elements of illegal possession of equipment, instrument, apparatus and other paraphernalia for dangerous drugs under Section 12 of RA No. 9165
    1. Possession or control by the accused of any equipment, apparatus or other paraphernalia fit or intended for smoking, consuming, administering, injecting, ingesting, or introducing any dangerous drug into the body
    2. Such possession is not authorized by law
  • In the present case, there is no evidence showing that the aluminum foil, tube, and lighters found in the petitioner's house were fit or intended for introducing any dangerous drug into the body. The prosecution did not bother to show that there were traces of shabu on any of these alleged drug paraphernalia. In fact, it appears that the only evidence that the prosecution offered to prove this charge is the existence of the seized items by themselves
