  • The CC hears appeals on conviction and/or sentences from MC:
    • Dismiss the appeal and confirm conviction and/or sentence decided in MC
    • They can allow the appeal and then change the conviction or can increase or decrease the sentence
    • may find the D guilty of a different offence
  • The High court hears appeals on point of law from the MC or appeals on points of law from the CC:
    • Dismiss the appeal and confirm decision made by the trial court
    • allow the appeal and then change the decision
    • send the case back to MC or the CC. under the Criminal Justice Act 2003 they can order a re-trial in front of a new jury
  • The Court of Appeal hears appeals on conviction and /or sentence from the CC:
    • Dismiss the appeal and confirm the conviction and/or sentence+
    • Allow the appeal and change the conviction or have a retrial, if they consider the conviction unsafe
    • they can decrease the sentence but not increase
    • The grounds of appeal are provided by the Criminal appeals court 1995
