Burglary

• • Burglary is provided in Section 9(1)(a) and in Section 9(1)(b) of the Theft Act 1968.
• Section 9(1)(a):

  The D has intention before entry to a building or part of a building as a trespasser to commit theft/GBH or criminal damage but doesn't commit them.
• Section 9(1)(b):

  The D has intention after entry to a building or part of a building as a trespasser to commit theft/GBH and does commit or attempts to commit them.
• Both Section 9(1)(a) and Section 9 (1)(b):

  The D has intention before entry to a building or part of a building as a trespasser to commit theft/GBH and does commit or attempt to commit them.
• If discussing S.9(1)(a):

  The Actus reus of S.9(1)(a) is entry to a building or part of a building as a trespasser
