  • RESPONSE
Categorical Imperative; would I want everyone who deserves prison to be imprisoned? You could argue, yes. If the punishment fits the crime and is the right punishment, it could be universalised.
  • RESPONSE 2
Kant is a big believer in duty. He could therefore argue that it is society's duty to follow the law, and if the law says prison for certain crimes, we are bound to imprison them.
  • ANALYSIS
    • There is one rule, applicable to everyone. This consistent approach means people know what to expect if they commit crime.
  • ANALYSIS
    • Consider personal circumstances, impact on family life, the chance of reformation, and the likelihood of reoffending before passing any sentence. Kantianism doesn't allow for these considerations.
