  • The Licensing Act 1872 • Section 12.
    Every person who is drunk while in charge on any highway or other public place of any carriage, horse, cattle, or steam engine, or who is drunk when in possession of any loaded finearms, shall be liable to a penalty not exceeding forty shillings, or in the discretion af the court to imprisonment for any term not exceeding one month.
  • The defendant was riding his bicycle while under the influence of alcohol. The court applied the mischief rule, holding that riding a bicycle was within the mischief of the act as the defendant represented a danger to himself and other road users.
  • Drunk driving a car or bicycle is illegal: any person who is drunk on any highway or public place while in charge of any carriage.
