• arbitration involes two parties that may be represented and a 3rd party (arbritrator) listens to evidence and arguments and makes a decision on behalf of parties
• the arbritator makes the final binding decision, parties are guarenteed to get an outcome and the process is voluntary
• appropriate when parties have agreed to arbitrate the dispute or the claim is less than 10000 and has been issued in the mag court
• appropriate when parties want the benefit of a binding and enforceable reward
• appropriate when parties want evidence to be presented to a third party
• innapropraite when the parties havent agreed to arbitrate, where the parties want greater control or they wish to have their 'day in court'
