• Loss of control comes from the Coroners and Justice Act 2009
• There are 3 parts to loss of control

  1. D's act or omission resulted from a "loss of control"
  2. The loss of self control had a qualifying trigger, either/both: fear and anger
  3. A person of D's sex and age, with a normal degree of tolerance and self restraint and in D's circumstance, might have reacted in the same or similar way
